شروط وأحكام استخدام تطبيق وموقع إيجارك

مرحباً بك في إيجارك. باستخدامك للتطبيق أو الموقع، فإنك توافق على الالتزام بهذه الشروط والأحكام. إذا كنت لا توافق عليها، يجب عليك عدم استخدام المنصة.

أولاً: تعريف المنصة

إيجارك منصة تكنولوجيا عقارية تهدف إلى ربط المالكين والمستأجرين، وتسهيل عرض العقارات، البحث عنها، إرسال طلبات الإيجار، وتحسين الثقة بين الأطراف من خلال أدوات التحقق والملفات الشخصية.

إيجارك لا يُعد طرفاً في عقد الإيجار بين المالك والمستأجر، ولا يُعتبر مالكاً أو مستأجراً أو وسيطاً قانونياً ملزماً إلا إذا تم النص صراحة على خلاف ذلك في اتفاق منفصل.

ثانياً: أهلية الاستخدام

باستخدامك للمنصة، تقر بأنك:

لديك الأهلية القانونية لاستخدام الخدمة.

تقدم بيانات صحيحة ودقيقة.

لا تستخدم المنصة لأغراض احتيالية أو غير قانونية.

تلتزم بالقوانين المصرية المنظمة للعقارات والإيجارات والتعاملات الإلكترونية.

ثالثاً: الحسابات

يجب إنشاء حساب لاستخدام بعض خصائص المنصة. أنت مسؤول عن:

صحة بيانات الحساب.

الحفاظ على سرية بيانات الدخول.

أي نشاط يتم من خلال حسابك.

تحديث بياناتك عند تغيرها.

يجوز لإيجارك تعليق أو تقييد أو حذف أي حساب في حال الاشتباه في إساءة الاستخدام أو تقديم بيانات مضللة أو مخالفة هذه الشروط.

رابعاً: حساب المالك

إذا كنت مالكاً أو معلناً عن عقار، فإنك تقر وتتعهد بما يلي:

أن لديك الحق القانوني في عرض العقار للإيجار.

أن بيانات العقار وصوره وسعره وموقعه صحيحة بقدر علمك.

ألا تعرض عقاراً لا تملك حق التصرف أو الإعلان عنه.

أن مستندات الملكية أو التفويض المقدمة صحيحة.

أن إيجارك له الحق في مراجعة أو رفض أو إيقاف نشر أي عقار عند وجود شك أو مخالفة.

خامساً: حساب المستأجر

إذا كنت مستأجراً، فإنك تقر وتتعهد بما يلي:

أن بياناتك الشخصية والمهنية صحيحة.

أن طلبات الإيجار التي ترسلها جادة وغير مضللة.

ألا تستخدم بيانات المالكين أو العقارات لأي غرض غير مشروع.

أن قبول طلبك من المالك لا يعني إتمام عقد الإيجار تلقائياً.

سادساً: التحقق من الهوية والمستندات

قد تطلب إيجارك من المستخدمين رفع مستندات هوية أو ملكية أو مستندات داعمة.

تحتفظ إيجارك بحق:

قبول أو رفض المستندات.

طلب مستندات إضافية.

تعليق الحساب أو العقار لحين استكمال التحقق.

إزالة أي محتوى مشكوك فيه أو مخالف.

لا يضمن التحقق داخل المنصة صحة كل البيانات بشكل مطلق، ولكنه يهدف إلى تقليل المخاطر وتحسين الثقة بين المستخدمين.

سابعاً: العقارات والمحتوى

يتحمل المستخدم الذي يضيف العقار المسؤولية الكاملة عن دقة وصحة المحتوى.

يُمنع نشر:

عقارات وهمية.

صور مضللة.

أسعار غير حقيقية.

بيانات اتصال غير صحيحة.

محتوى مخالف للقانون أو الآداب العامة.

محتوى ينتهك حقوق الغير.

يجوز لإيجارك تعديل أو إخفاء أو حذف أي محتوى يخالف هذه الشروط.

ثامناً: طلبات الإيجار

إرسال طلب إيجار لا يُعد عقداً ملزماً. قبول المالك للطلب يعني فقط موافقته المبدئية على التواصل أو التفاوض مع المستأجر.

أي اتفاق نهائي أو عقد إيجار أو دفع أو تسليم يتم بين الطرفين يكون على مسؤوليتهما، ما لم تقدم إيجارك خدمة تعاقدية منفصلة بشروط واضحة ومكتوبة.

تاسعاً: إظهار بيانات التواصل

لا يتم إظهار رقم هاتف المالك للمستأجر إلا بعد قبول طلب الإيجار، وذلك لحماية الخصوصية وتقليل التواصل غير الجاد.

يجب على المستخدمين عدم إساءة استخدام بيانات التواصل أو مشاركتها خارج الغرض المشروع من الطلب.

عاشراً: العقود الإلكترونية المستقبلية

قد تضيف إيجارك مستقبلاً خاصية إنشاء أو إدارة عقود الإيجار رقمياً. إلى أن يتم إطلاق هذه الخاصية رسمياً، فإن أي نماذج أو بيانات معروضة داخل المنصة لا تُعد بديلاً عن الاستشارة القانونية أو التوثيق الرسمي عند الحاجة.

حادي عشر: الرسوم والخدمات المدفوعة

قد تكون بعض خدمات إيجارك مجانية في مرحلة MVP. وقد يتم لاحقاً إضافة خدمات مدفوعة، اشتراكات، إعلانات، توثيق إضافي، أو خدمات مميزة.

سيتم توضيح أي رسوم قبل تحصيلها من المستخدم.

ثاني عشر: حدود المسؤولية

تسعى إيجارك إلى توفير خدمة مفيدة وآمنة، لكنها لا تضمن:

إتمام أي عملية إيجار.

صدق كل مستخدم بنسبة مطلقة.

خلو كل إعلان من الأخطاء.

استمرار الخدمة دون انقطاع أو أخطاء تقنية.

ملاءمة العقار لاحتياجات المستأجر.

تكون مسؤولية أي اتفاق أو معاينة أو دفع أو تعاقد نهائي بين المالك والمستأجر على عاتق الطرفين.

ثالث عشر: السلوك المحظور

يُحظر على المستخدم:

استخدام المنصة في الاحتيال أو التضليل.

انتحال شخصية الغير.

رفع مستندات مزورة.

جمع بيانات المستخدمين بدون إذن.

محاولة اختراق أو تعطيل المنصة.

نشر محتوى مخالف أو مسيء.

استخدام المنصة لغرض غير مرتبط بالإيجار المشروع.

رابع عشر: الملكية الفكرية

جميع حقوق الملكية الفكرية المتعلقة باسم إيجارك، الشعار، التصميمات، البرمجيات، النصوص، وقواعد البيانات مملوكة لإيجارك أو للجهات المرخصة لها.

لا يجوز نسخ أو إعادة استخدام أو استغلال أي جزء من المنصة دون موافقة كتابية مسبقة.

خامس عشر: تعليق أو إنهاء الحساب

يجوز لإيجارك تعليق أو إنهاء الحساب أو إزالة المحتوى إذا:

خالف المستخدم هذه الشروط.

قدم بيانات غير صحيحة.

استخدم المنصة بطريقة ضارة.

خالف القانون.

تسبب في ضرر للمستخدمين أو للمنصة.

سادس عشر: تعديل الشروط

يجوز لإيجارك تعديل هذه الشروط من وقت لآخر. سيتم نشر النسخة المحدثة داخل التطبيق أو على الموقع. استمرار استخدامك للمنصة بعد التحديث يعني قبولك بالشروط المعدلة.

سابع عشر: القانون والاختصاص

تخضع هذه الشروط لقوانين جمهورية مصر العربية، وتختص المحاكم المصرية المختصة بنظر أي نزاع ينشأ عن استخدام المنصة.

Welcome to Egarak. By using the app or website, you agree to comply with these Terms and Conditions. If you do not agree, you must not use the platform.

1. Platform Description

Egarak is a proptech rental platform designed to connect property owners and tenants, facilitate property listing and search, enable rental requests, and improve trust through verification tools and user profiles.

Egarak is not a party to the lease agreement between owner and tenant and is not itself a landlord, tenant, or legally binding broker unless expressly stated in a separate written agreement.

2. Eligibility

By using the platform, you confirm that:

You have legal capacity to use the service.

You provide accurate and truthful information.

You will not use the platform for fraudulent or unlawful purposes.

You will comply with Egyptian laws related to real estate, leasing, and electronic transactions.

3. Accounts

Certain features require an account. You are responsible for:

The accuracy of account information.

Maintaining the confidentiality of login credentials.

Any activity under your account.

Updating your information when it changes.

Egarak may suspend, restrict, or delete accounts where misuse, misleading information, or violation of these Terms is suspected.

4. Owner Accounts

If you are an owner or property advertiser, you represent and warrant that:

You have the legal right to list the property for rent.

Property details, photos, price, and location are accurate to the best of your knowledge.

You will not list properties that you are not authorized to advertise.

Ownership or authorization documents submitted by you are valid.

Egarak may review, reject, suspend, or remove any property where there is suspicion or violation.

5. Tenant Accounts

If you are a tenant, you represent and warrant that:

Your personal and professional information is accurate.

Your rental requests are genuine and not misleading.

You will not misuse owner or property data.

Owner acceptance of your request does not automatically create a lease agreement.

6. Identity and Document Verification

Egarak may request identity, ownership, or supporting documents from users.

Egarak reserves the right to:

Accept or reject documents.

Request additional documents.

Suspend accounts or properties until verification is completed.

Remove suspicious or non-compliant content.

Verification on the platform does not guarantee absolute accuracy of all user-provided information. It is intended to reduce risk and improve trust.

7. Property Listings and Content

The user who lists a property is fully responsible for the accuracy and legality of the listing.

Users must not publish:

Fake properties.

Misleading photos.

False prices.

Incorrect contact information.

Illegal or offensive content.

Content that infringes third-party rights.

Egarak may edit, hide, or delete content that violates these Terms.

8. Rental Requests

Submitting a rental request does not create a binding lease. Owner acceptance only means preliminary approval to communicate or negotiate with the tenant.

Any final agreement, lease contract, payment, inspection, or handover is the responsibility of the owner and tenant unless Egarak provides a separate contractual service under clear written terms.

9. Contact Information Disclosure

The owner’s phone number is not shown to the tenant unless the owner accepts the rental request. This protects privacy and reduces unserious communication.

Users must not misuse contact information or share it outside the legitimate purpose of the request.

10. Future Digital Contract Features

Egarak may later introduce digital lease contract creation or management features. Until officially launched, any templates or data shown on the platform are not a substitute for legal advice or official notarization where required.

11. Fees and Paid Services

Some Egarak services may be free during the MVP stage. Egarak may later introduce paid services, subscriptions, advertisements, additional verification, or premium features.

Any applicable fees will be disclosed before charging users.

12. Limitation of Liability

Egarak aims to provide a useful and safe service but does not guarantee:

Completion of any rental transaction.

Absolute truthfulness of every user.

Error-free listings.

Uninterrupted or error-free service.

Suitability of any property for a tenant’s needs.

Any final inspection, payment, agreement, or lease contract remains the responsibility of the owner and tenant.

13. Prohibited Conduct

Users must not:

Use the platform for fraud or deception.

Impersonate another person.

Upload forged documents.

Collect user data without permission.

Attempt to hack or disrupt the platform.

Publish illegal or offensive content.

Use the platform for purposes unrelated to lawful rental activity.

14. Intellectual Property

All intellectual property rights related to the Egarak name, logo, designs, software, text, and databases are owned by Egarak or its licensors.

No part of the platform may be copied, reused, or exploited without prior written consent.

15. Suspension or Termination

Egarak may suspend or terminate an account or remove content if a user:

Violates these Terms.

Provides false information.

Misuses the platform.

Violates the law.

Causes harm to users or the platform.

16. Changes to These Terms

Egarak may update these Terms from time to time. The updated version will be published in the app or on the website. Continued use of the platform after publication means acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Arab Republic of Egypt. The competent Egyptian courts shall have jurisdiction over any dispute arising from use of the platform.
